VA Simplifies Survivors’ Benefits Claims Process to Ensure Faster Payments and Decisions

The US Department of Veterans Affairs (VA) has introduced a new regulation designed to streamline the claims process for survivors, enabling faster decisions and quicker payments for certain claims. Previously, claims for Dependency and Indemnity Compensation (DIC) and Survivors Pension were processed separately, requiring formal decisions for both benefits and extending the time required to finalize claims.

Effective February 23, the VA will prioritize and pay the higher of the two benefits, which is typically DIC, without delaying the process to develop the lesser benefit. This adjustment aims to simplify the process, reduce administrative burdens, and provide beneficiaries with quicker resolutions during difficult circumstances, according to VA Secretary Doug Collins.

DIC is a tax-free monthly benefit provided to eligible surviving spouses, children, and parents of service members who died in the line of duty or veterans who passed away due to service-related injuries or illnesses. Survivors Pension is another tax-free monthly benefit available to qualified surviving spouses and unmarried dependent children of wartime veterans, provided they meet the income and net worth criteria established by Congress.

In most cases, DIC offers greater financial support than Survivors Pension. However, Survivors Pension may be awarded under specific conditions, including if the claimant is the veteran’s surviving spouse, has no dependents, resides in a nursing home, and is receiving or has applied for Medicaid. In these instances, Survivors Pension will be granted, and the DIC claim will not proceed further.
